1. Acceptance of Terms

By using SemCair.ai ("Service"), available through the SemCair.ai app and through our WhatsApp support, you agree to these Terms of Use. If you do not agree, discontinue use immediately.

2. Service Description

SemCair.ai is an independent automated assistant that helps identify signs of possible scams and digital fraud, including analyzing links, PIX keys, invoices, telephone numbers and suspicious messages. The Service uses automated analysis, public databases and operational providers to offer informative and indicative analyses.

2.1 Independent Nature

SemCair.ai is not a bank, financial institution, public body, WhatsApp, Meta, Google, store, operator, card company or official representative of third parties. Brands, banks, bodies or platforms mentioned in analyzes are only mentioned to contextualize risks reported by the user.

2.2 Data We Never Request

The Service never requests a password, token, SMS code, authentication code, CVV, full card details, bank login, document photo, selfie, remote access or credentials. The user must submit only suspicious content necessary for analysis and remove unnecessary personal data before submission.

3. Limitation of Liability

The SemCair.ai provides indicative analyzes based on known patterns of fraud. The Service:

• Does not guarantee detection of 100% of scams;
• Does not replace guidance from competent authorities (Polícia Civil, Procon, Banco Central);
• Does not constitute legal, financial or technical opinion;
• Not responsible for decisions made based on the analysis provided;
• Does not guarantee the recovery of values ​​in the event of a completed scam.

In the event of a successful scam, immediately contact the competent authorities. The assistant can guide the first steps, but the responsibility for the action lies with the user.

4. Plans, Payments, Cancellation and Refunds

4.1 Plans. The Service offers a free plan (5 evaluation checks) and paid plans with checks according to the commercial limits shown on the main page. Subscriptions purchased in the app are charged and renewed automatically by the app store (Google Play or App Store), under the store's own terms. Purchases made outside the stores, through WhatsApp support, are processed by Asaas or another payment provider informed at the time of purchase.

4.2 Cancellation. You can cancel at any time in the store itself: on Android, Play Store > Payments & subscriptions > Subscriptions > SemCair.ai; on iPhone, Settings > your name > Subscriptions > SemCair.ai. Cancelling stops future charges and you keep access until the end of the period already paid. Cancelling alone does not refund amounts already charged. Deleting your account in the app does not cancel the subscription in the store.

4.3 Right of withdrawal and refunds. Under article 49 of the Brazilian Consumer Defense Code, you may withdraw from the subscription within 7 (seven) calendar days of the most recent charge, including a renewal, and receive that charge back. This refund is granted once per person, checked by account, device and registered phone (we store only an irreversible code of this data), to protect the Service from misuse. To request it, write to contato@semcair.com.br with the account name or phone; we reply within 24 hours. After the refund, paid access ends immediately. For subscriptions bought on iPhone (App Store), Apple processes the refund: request it at reportaproblem.apple.com.

4.4 Other cases. Wrongful or duplicate charges, suspected fraud against you, a Service failure that prevents use, or a court order are reviewed individually, even after the deadline or after a previous refund. Within 48 hours of purchase you may also ask Google Play directly for a refund, under the store's rules. How long the money takes to return depends on the payment method and the store.

4.5 No guarantee of results. This refund policy is not a guarantee of results, detection or recovery of funds in case of a scam.

5. Acceptable Use

You agree not to use the Service to:

• Send illegal, offensive content or content that violates the rights of third parties;
• Overload the system with automated requests (bots, scripts);
• Try to access data from other users;
• Send passwords, authentication codes, CVV, full card details, bank login, photos of personal ID documents, selfies or your own or third party credentials;
• Use analyzes for commercial purposes without prior authorization.

6. Intellectual Property

All content, design, algorithms and SemCair.ai brand are the exclusive property of the company. Reproduction without express authorization is prohibited.

7. Suspension and Cancellation

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive or automated behavior, without prior notice. You may also delete your account at any time — see Account and data deletion. The app is intended for people aged 18 or over.

8. Changes to Terms

We may update these Terms at any time. The latest version will always be available on this page. Continued use of the Service after changes implies acceptance of the new terms.

9. Jurisdiction and Legislation

These Terms are governed by Brazilian law. The jurisdiction of the district of São Paulo/SP is hereby elected to resolve any disputes.
